Terms and Conditions for https://en.escapio.com (Operator: escapio GmbH, hereinafter “escapio”; full contact details are provided at the end of these Terms), effective as of April 1, 2025 (references to statutory provisions refer to the version of the German Civil Code [BGB] effective July 1, 2018).
Through our website, on which tourism services (currently exclusively various accommodation offers) are presented, we provide different types of services that must be legally categorized differently and are therefore described and governed separately in these Terms and Conditions:
When used as a platform (buttons such as “View offer,” “Go to provider,” “Go to deal,” or by clicking on listed internet addresses such as booking.com or expedia.com), we present content from third-party providers. We do not act as an intermediary or tour operator; we merely establish contact for you free of charge and facilitate the initiation of a contract. A new window will open, and you will complete your booking directly on the third-party provider’s website; this is governed in Section A of these Terms and Conditions.
When using the “Book now” button, you may book accommodation services exclusively through us. Since these are the same type of travel services for the same or multiple trips (§ 651a para. 2 BGB), only an intermediary agreement is concluded with us, while the contract for the actual service is concluded with the third-party provider; these cases are governed in Section B of these Terms and Conditions.
The following provisions apply uniformly to all matters governed in Sections A and B, including out-of-court dispute resolution, amendment clause, withdrawal rights, as well as our data protection policy and jurisdiction provisions:
Out-of-court dispute resolution / right of withdrawal:
Providers of tourism services and tour operators are currently not legally required to participate in out-of-court dispute resolution proceedings before a consumer arbitration board. Whether we are willing to participate is determined on a case-by-case basis once a dispute arises. Regardless of this, applicable law requires that a link to the European Commission’s online dispute resolution platform be provided: https://ec.europa.eu/consumers/odr/main/index.cfm.
A right of withdrawal pursuant to Sections 312 et seq. BGB exists for tourism brokerage agreements and travel contracts only in a special case not applicable to online bookings (unsolicited home visit). Only statutory rights of withdrawal or termination, or contractually agreed cancellation or termination rights, apply.
Data Protection
Data protection is of the highest priority at escapio and is governed by the German Federal Data Protection Act (BDSG) and the Telemedia Act (TMG). Personal data is collected, processed, or used only if the user has given consent or if a legal provision permits such collection, processing, or use. Detailed data protection provisions are available at https://en.escapio.com/data-security.
Governing Law and Jurisdiction:
All legal relationships between escapio and the user shall be governed exclusively by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG), unless mandatory consumer protection laws of the country in which the consumer has their habitual residence take precedence.
If the user is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract shall be the registered office of escapio.
The same applies if the user— including a consumer—does not have a general place of jurisdiction in Germany or if their residence or habitual abode is unknown at the time the action is filed.
Amendment Clause:
escapio may amend these Terms and Conditions. If such changes are material, we will notify you before they take effect unless the changes are required by applicable law. If you do not agree to the changes, please refrain from using our platform. Otherwise, your continued use of our platform after the effective date of the changes constitutes your acceptance of the revised Terms and Conditions. Existing bookings remain subject to the Terms and Conditions in effect at the time of booking.
A. Use as a Platform / Facilitation of Contract Formation
1. Facilitation of Contract Formation
Where escapio displays services from third-party providers, this is based on information provided by those providers. escapio updates prices and availability of third-party providers in real time. Nevertheless, in rare cases, the information displayed on escapio may differ from the information shown by the third-party provider after accessing their website.
Links to booking offers from third-party providers do not constitute a recommendation.
If you access external websites (those of third-party providers) via the “View offer” button or by clicking on a listed internet address (such as booking.com or expedia.com), and you complete a booking there, the resulting contract is concluded exclusively between you and the third-party provider. Your booking and payment data are entered only on the external site; your address and banking details are also only known to the operator of that external site.
2. General Information on Contracts with Third-Party Providers
The contract concluded with the third-party provider is governed by the applicable legal provisions and, where applicable, the validly incorporated terms and conditions of the third-party provider. All rights and obligations arising from such a contract exist exclusively between you and the third-party provider. The third-party provider is solely responsible for any warranty or service claims.
3. Liability of escapio
The information available on escapio’s website (in particular descriptions, images, prices, and availability) is based on information provided by hotels and third-party providers. escapio cannot verify the accuracy, completeness, or timeliness of this information. Accordingly, escapio makes no warranties or representations regarding the information provided by third parties. escapio assumes no liability for advertising links (text links or banners) or for content displayed on third-party websites.
Claims for damages against escapio are excluded. This does not apply to claims arising from injury to life, body, or health, or from the negligent breach of essential contractual obligations, or for damages caused by intentional or grossly negligent breaches of duty by escapio or its agents. Essential contractual obligations are those whose fulfillment is necessary for the proper execution of the contract and on whose compliance the user may regularly rely. In the event of a breach of essential contractual obligations, escapio shall only be liable for foreseeable, contract-typical damages in cases of simple negligence, unless the claim relates to injury to life, body, or health.
Liability under the German Product Liability Act, guarantees, fraudulent misrepresentation, or other mandatory statutory liability provisions remains unaffected. The above limitations of liability also apply to legal representatives, employees, and agents of escapio.
Applicable statutory provisions shall apply additionally.
B. Acting as an Intermediary for Travel Providers
We act as an intermediary for hotel partners / travel providers whose offers are displayed on the escapio website, with the authority to conclude contracts for the sale of such travel offers on their behalf with you.
Your contract for the travel offer is concluded directly with the hotel partner / travel provider. escapio is not a contracting party. The provision of the purchased travel services is subject to the terms and conditions displayed on the respective offer page and accepted by you.
By purchasing a travel offer via escapio, you agree to the applicable terms and conditions and acknowledge that you enter into a contract directly with the hotel partner / travel provider.
Since your contract is concluded with the hotel partner / travel provider, we are not responsible for the performance of the travel services. Accordingly, we assume no liability for any damages arising from the use of the travel offer.
1. Booking
You may book offers from hotel partners / travel providers via escapio. Your booking constitutes a binding offer. You acknowledge that you are obligated to pay for the booked offer. We will process payment according to the payment method selected after accepting your booking.
If we cannot accept your booking (e.g., due to lack of availability or pricing errors—see Section 3 below), we will inform you by email and will not process your booking.
The booking process allows you to review and correct any errors before submitting your booking. Please carefully review all details, services, conditions, and the total travel price at each step. Please provide accurate contact information so that we and/or the service provider can provide booking information and contact you if necessary.
After successful payment, escapio will send a booking confirmation email containing all relevant details of your travel offer and the hotel partner / travel provider. This email confirms receipt of your booking and payment.
2. Prices
The price of a travel offer is as stated on the website at the time of booking, except in cases of obvious error. Prices include applicable value-added tax. Prices may change over time, and you will be informed of the current price at the time of booking.
By making a booking, you agree to pay the cost of the travel experience and any additional applicable fees and taxes.
Due to the large number of travel offers, pricing errors may occur despite our reasonable efforts. Obvious errors are not binding. For example, if a suite is mistakenly offered for €10, we reserve the right to cancel the booking and refund any payments made.
3. Payment
escapio acts as an intermediary on behalf of the hotel partner / travel provider by collecting payments using the payment methods offered on our website. Payment must be made at the time of booking.
For payments via Klarna, credit card, or “Sofort,” escapio cooperates with Stripe GmbH, Prielmayerstraße 3, 80335 Munich (“Stripe”). If a valid contract is concluded, escapio assigns its payment claim to Stripe. By using Stripe payment methods, the customer consents to the transfer of personal data for identity verification, credit assessment, and contract processing purposes. Details are set out in Stripe’s terms and privacy policy.
By completing a booking, you confirm that the payment information provided is accurate. If a payment method is declined, we may contact you or cancel the booking.
escapio acts solely as an intermediary and cannot issue invoices for services provided by hotel partners / travel providers. escapio provides a booking confirmation that may serve as proof of payment.
4. Policies
The intermediary agreement between you and escapio is fulfilled once the booking is successfully completed. Since the offers are non-refundable and non-changeable, bookings cannot be modified or canceled for a refund. By booking, you accept the applicable policies displayed during the booking process.
5. Liability in Connection with Mediated Purchases
The provision of travel services is not part of the contractual relationship between you and escapio. The respective travel provider is solely responsible for the performance of the services. escapio assumes no liability for such services.
All information about travel services is based solely on information provided by the travel provider. escapio cannot verify accuracy, completeness, or timeliness and makes no representations in this regard.
Claims for damages against escapio are excluded subject to the same exceptions and limitations described above.
Applicable statutory provisions shall apply additionally.
