Requests and bookings

Escapio operates as an agent and forwards the requests and bookings to the selected hotel on behalf of the traveler.

It is intended that accommodation offers be provided exclusively to travelers who use Escapio to find them. This includes private bookings for the traveler him or herself, his or her acquaintances or relatives and bookings by companies for their employees.

Commercial resale of accommodation offers obtained from Escapio without expressly written agreement from Escapio is prohibited.

Accommodation contract and payment

When accommodation is arranged through Escapio, the accommodation contract comes into effect directly between the traveler and the hotel selected by the traveler. The traveler must pay the accommodation costs quoted by Escapio directly to the hotel. All claims and obligations arising from the accommodation contract exist directly and exclusively between the traveler and the hotel he or she selects.

Once the traveler has received a booking confirmation from Escapio, a binding room booking for the selected hotel comes into effect. The room booking is valid without any other written booking confirmation. Once the booking is complete, Escapio displays the booking confirmation on the internet browser. The traveler also receives the booking confirmation by email.

Due to technical uncertainties in the transfer of e-mails over the internet, Escapio can neither check nor guarantee the arrival of the booking confirmation by email. However, this does not affect the validity of the booking.

Arrival and cancellation

In accordance with the conditions of the hotel, the traveler is obliged to arrive by the specified time. In the case of late cancellation or non-show (non-arrival), the hotel will charge the cancellation fee specified by Escapio.

In order to avoid misunderstandings, changes or cancellations of bookings arranged via Escapio must always be made using Escapio. It is important that the selected hotel receives the respective message from Escapio in order that the change or cancellation can be made on time.

Escapio reserves the right to temporarily or permanently exclude internet users from its use and/or to cancel availability requests or bookings, if availability requests or bookings were repeatedly made in the past using the e-mail address given by the traveler and were not subsequently carried out.

Information on accommodation offers

Escapio does its best to verify the accuracy of the hotel information (pictures, text, map, prices etc.) it displays. However, it is ultimately based on the information provided by the hotel, the experience of Escapio employees or information provided by reliable third parties (e.g. travelers). As much as possible, Escapio tries to ensure that the content of the hotel information is accurate, up-to-date and complete. However, that the content is accurate, up-to-date and complete cannot be guaranteed with complete certainty and Escapio therefore accepts no responsibility for this.

The hotel star classification displayed by Escapio is the standard international hotel classification. The information is based on that provided by the hotel.

Room prices

Unless otherwise expressly stated, the room prices given are valid per room, per night.

The prices shown for hotels in Germany include VAT. The charges added to the room price in other countries (for example taxes or service charges) are dependent on the regulations of the country concerned or individual regions of the country concerned. These amounts are subject to change and are therefore quoted by Escapio only without obligation.

If a currency other than Euro is selected, the prices are shown in the selected currency for orientation only and without obligation. The conversion is carried out using the most up-to-date exchange rate available. The traveler’s payment to the hotel may vary depending on new exchange rates.

Liability and warranty

All information has been compiled with the greatest care. However, no responsibility can be accepted for any errors made during data acquisition or data transfer. Escapio therefore accepts no responsibility for ensuring that the contents made available are accurate, complete and up-to-date. Particular entries regarding prices and room availabilities are the sole responsibility of the hotels, in so far that Escapio accepts no responsibility for information given by the hotel. This also applies to false information given by the hotel, which results in double-bookings.

Escapio accepts no responsibility for breaches of duty due to minor negligence, insofar as there is no effect on contractual responsibilities, life, health or body or claims in accordance with the German Law on Product Liability.

Escapio is liable for damages - irrespective of legal grounds - only in the case of intentional and gross negligence. The liability is strictly limited to the foreseeable, typical damages relating to the contract.

The aforementioned limitations of liability apply accordingly to breaches of duty by Escapio assistants.>/p>

The current version of the Data Protection Directive is valid.

Newsletter/E-mail notification

When registering at Escapio you will regularly receive Escapio news and details of current special offers by e-mail. You may cancel the subscription of the newsletter at any time by clicking on the unsubscribe-link in the newsletter.

Miscellaneous

Escapio reserves the right to all use and application of published contents. The replication, reproduction, distribution, electronic storage or transfer of all or part of the data to other data media or its use for any purpose other than those stated here is permitted only with the expressly written agreement of Escapio.

In the case of infringements of these General Terms and Conditions, Escapio reserves the right to exclude travelers at any time from its further use, (cf. above). Such exclusion also includes deleting and blocking personal settings created by the traveler ("My Escapio").

Escapio reserves the right to restrict, change or completely cease the use of Escapio at any time and without prior notification. A legal claim by the user against the use of Escapio is not possible.

Escapio shall inform the user of changes to these conditions of use on its website or by e-mail. If the user does not object to such changes within four weeks of notification, the changes shall be considered agreed.

Liability exclusion for links

In its decision from the 12th of May 1998, Hamburg County Court resolved that the posting of a link results in shared responsibility for the contents of the linked site, where applicable. According to Hamburg County Court, this can only be avoided if the poster of the link expressly distances him/herself from these contents. Escapio has posted links to external websites whose contents are not influenced by Escapio. The following therefore applies for all links: Escapio has no influence on the configuration or contents of external websites. Escapio therefore distances itself from the contents of all external websites, even when Escapio posted a link to these external websites.

Applicable law / Place of jurisdiction

All legal relations between Escapio and the user shall be subject exclusively to the law of the Federal Republic of Germany.

Insofar as legally permissible, the exclusive place of jurisdiction for all disputes arising in relation to use of Escapio is agreed to be Berlin. Alternatively, state law is applicable.
